The Biggest Risk: NC Police Procedures

Law enforcement lacks the time or resources for a comprehensive cannabis education program, leading to long-standing testing procedures. This process inevitably transforms THCa hemp products into Delta 9 THC. Regrettably, due to this flawed testing process, authorities will assert that the confiscated THCa hemp is illicit THC marijuana. The THCa flower will not be returned, and legal action is probable.

Tips for Reducing the Risk of an Arrest for THCa Flower

According to the International Cannabis Attorney, until everyone is educated on the legality of THCa flower, it is highly recommended to follow these tips to reduce the risk of an arrest.

1. Consume THCa Flower Somewhere Private

Smoking or vaping in public, or in a car in a public place, is a very high risk activity. People can easily detect the aroma of cannabis smoke and vapes. Most likely, they will assume it is marijuana. Even if the authorities are absent, individuals in the vicinity may capture images and inform law enforcement. Hence, it is advisable to consume THCa flower through smoking or vaping at a personal residence.

2. Don’t Leave THCa Flower in Plain Sight

Given law enforcement's lack of knowledge about THCa, it's advisable not to leave any on the car seats or dashboard. The presence or scent of cannabis, including THCa hemp, could result in a search, seizure, and arrest. The optimal location for storing THCa flower during transportation is within the trunk of the vehicle. This will ensure it remains concealed and prevents any odors from escaping. It is recommended to place the flower inside a cool environment to prevent exposure to high temperatures that may build up in the trunk on a hot day.

3. Do Not Consent to a Vehicle Search

If the authorities request to search the vehicle, the driver can decline consent. This does not guarantee the vehicle will not be searched. However, without consent, any evidence may be invalidated if the officer lacks probable cause for the search.Since marijuana and hemp require a lab test to determine the difference, just the sight of it is not considered probable cause for a search.

4. Keep the Receipt

Presenting the receipt to a law enforcement officer will demonstrate that the THCa flower was acquired from a lawful establishment or online retailer, not the illicit market. Establishing an individual's intention is paramount in determining criminal activity. Furnishing a recent dated receipt significantly supports lawful intent.
